Introduction

These Terms & Conditions govern your use of zenmarkup.com and any web development services provided by Tony Skoryk (“ZenMarkup”, “I”, “me”). By using this website or engaging my services, you agree to these terms.

Services

I offer custom web development, WordPress theme development, performance optimization, and consulting services. The specific scope, deliverables, and timeline for each project are defined in a separate project agreement before work begins.

Process

Every project follows a clear process:

  1. Audit — I review your current situation and requirements
  2. Proposal — I present a solution with scope, timeline, and pricing
  3. Agreement — We agree on the terms before any work starts
  4. Implementation — I build the solution with regular progress updates
  5. Delivery — Final review, handover, and support period

Payment

Payment terms are defined in each project agreement.

Intellectual Property

Upon full and final payment, you receive complete ownership of all project deliverables — code, design, content created for your project. I retain the right to showcase the work in my portfolio and case studies, unless we agree otherwise in writing.

Third-party components (open-source libraries, WordPress core, licensed fonts) remain under their respective licenses.

Liability

I deliver work to the best of my professional ability. However, I cannot guarantee specific business outcomes (revenue, rankings, conversion rates) as these depend on many factors beyond my control.

I am not liable for:

  • Issues caused by your hosting provider or third-party services
  • Changes made to the deliverables by you or other parties after handover
  • Data loss due to lack of backups on your end
  • Downtime or issues outside the agreed scope of work

Cancellation

Either party may cancel a project with written notice via email. In case of cancellation, you pay for the work already completed up to the cancellation date. Any materials or code produced up to that point will be delivered to you.

Confidentiality

I treat all project information as confidential. Your business data, credentials, and internal processes are never shared with third parties. I expect the same courtesy regarding my working methods and pricing.

Governing Law

These terms are governed by the laws of Ukraine. In case of any dispute, both parties agree to attempt resolution through good-faith negotiation before pursuing any legal action.

Changes

These terms may be updated. The current version is always available on this page. The date of the last update is shown at the top of this page. Continued use of the website or services after changes constitutes acceptance.
